1. Agreement to Terms

By accessing or using Quackscape (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. The Service is offered subject to your acceptance without modification of all of the terms and conditions contained herein.

By using the Service, you represent and warrant that you are at least 13 years of age (or the required age in your jurisdiction) and that you have the legal capacity to enter into these Terms.

2. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal or business purposes.

The Service is provided on a "best effort" basis. We do not guarantee that the Service will be available at all times or without interruption. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

3.1 Account Creation

This license is for the limited purpose of operating, promoting, and improving the Service, and to develop new services. This license does not grant us the right to sell your User Content or otherwise distribute it outside of the Service without your permission.

4.3 Content Representations

You represent and warrant that:

• You own the User Content or have the necessary rights and permissions to use and authorize us to use it
• Your User Content does not infringe, violate, or misappropriate the rights of any third party
• You have obtained all necessary consents from any individuals who appear in your User Content

4.4 Content Restrictions

You agree not to upload, post, or transmit any User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Contains violence or offensive subject matter
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Contains any private or personal information of a third party without consent
• Contains viruses, corrupted data, or other harmful, disruptive, or destructive files
• Is false, misleading, or deceptive

4.5 Content Removal

We reserve the right, but not the obligation, to:

• Monitor User Content
• Remove or refuse any User Content that violates these Terms
• Remove or refuse any User Content for any reason at our sole discretion

5. Prohibited Uses

In addition to other prohibitions as set forth in these Terms, you are prohibited from using the Service or its content:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• To interfere with or circumvent the security features of the Service without our prior written permission
• To use any automated system to access the Service without our prior written permission

6. Intellectual Property Rights

6.1 Service Ownership

The Quackscape name and logo are property of Private.coffee and protected by copyright law.

The Quackscape software is developed by Private.coffee and available as open-source software under the MIT license. You can find the source code on our Git repository at git.private.coffee.

6.2 Your Copyright

We are committed to respecting the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of where the material you claim is infringing is located on the Service
• Your contact information, including your email address
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
• A statement that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

7. Privacy Policy

The Service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of the Service or any content provided through the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Private.coffee, its affiliates, or their respective directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to defend, indemnify, and hold harmless Private.coffee, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your User Content
• Your violation of any rights of another party
• Your violation of any applicable laws

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by:

• Posting the updated Terms on our website
• Updating the "Last updated" date at the top of these Terms

Your continued use of the Service after any changes to these Terms constitutes your acceptance of such changes.
